On March 27, 2020, the Louisiana Insurance Commissioner issued Emergency Rule 40 requiring all insurance companies to suspend cancellation, nonrenewal and nonreinstatement retroactively to the start of this emergency period. Additionally, this rule clarifies that no policy can be cancelled or not renewed because of a claim that is filed during this emergency, though policies may continue to be canceled for fraud and material misrepresentation or upon written request by the consumer.

Insureds remain obligated to pay all premiums. Any property and casualty claim during this period is subject to a premium offset prior to payment. Emergency Rule 40 does not apply to new policies issued after the effective date of the rule.

On March 31, 2020, the Louisiana House of Representatives introduced House Bill 858 (companion Senate Bill 477) mandating that every policy insuring against loss or damage to property, which includes business interruption shall be construed to include coverage for COVID-19 business interruptions. The bills would have retroactive effective dates of March 11, 2020.
