On March 9, 2020, the Mississippi Insurance Department posted FAQs related to insurance and COVID-19, including an FAQ on travel insurance. The FAQ instructed insureds to carefully read their travel insurance policy to determine if pandemics, such as coronavirus, are covered. The FAQ also suggested the insured call the insurance company to figure out what’s covered under their policy, noting that every provider offers different insurance options that can vary depending on what the insured selects.

On March 25, 2020, the Mississippi Insurance Department issued Bulletin 2020-3 in which it created a 60-day moratorium on the cancellation/nonrenewal of policies for the nonpayment of premiums. The Bulletin also notes that this moratorium is not a waiver of premium; rather, it is a moratorium on the cancellation or nonrenewal of policies for the failure to pay premiums during the applicable 60-day period.

On March 25, 2020, the Mississippi Insurance Department issued Bulletin 2020-4 clarifying the 60-day moratorium outlined in Bulletin 2020-3, stating the following:

  • Insurers may issue cancellation/nonrenewal notices for nonpayment of premiums during the sixty (60) day moratorium period.
  • When such notices are issued during the sixty (60) day moratorium, notice periods required by statute or the policy may begin to run, but in no event may a cancellation/nonrenewal for nonpayment be effective until after the sixty (60) day moratorium period expires.

On April 1, 2020 the Commissioner of Insurance issued Bulletin 2020-4 clarifying that insurers may issue cancellation/nonrenewal notices for nonpayment of premiums during the 60- day moratorium period.
