Insurance Commissioner Issues Emergency Regulation Concerning Coverage for Delivery Drivers

On March 26, 2020, the Colorado Insurance Commissioner issued Emergency Regulation 20-E-03 providing guidance on extensions of automobile insurance coverage for personal delivery drivers to aid people temporarily assigned this duty during the coronavirus pandemic and state of emergency.

INSURANCE COMMISSIONER ISSUES BULLETIN CONCERNING NONPAYMENT OF PREMIUMS

On March 27, 2020, the Colorado Division of Insurance issued Bulletin No. B-5.38 to all insurers issuing coverage to personal and commercial policyholders directing them to make reasonable accommodations to prevent individuals and businesses from losing coverage due to cancellation for the nonpayment of premium, including:
- Extending premium grace periods
- Waiving of late payment fees
- Creating a moratorium on cancellations for non-payment
- Deferring any nonrenewal underwriting actions
- Providing a continuation of coverage for any expiring policy
Insurers should take steps to encourage the use of electronic payment technology on websites, apps and electronic bank transfers whenever possible. Insurers should be aware the Division will request data from the insurers related to the Division’s position.

DIVISION OF INSURANCE ISSUES BULLETIN CONCERNING PREMIUM DISCOUNTS

On April 6, 2020, the Colorado Division of Insurance issued Bulletin No. B-5.39 requiring submission of a filing if a P&C insurer chooses to implement any discounts or premium relief actions during the COVID-19 pandemic.
