ILLINOIS DEPARTMENT OF INSURANCE ISSUES BULLETIN REGARDING CANCELLATION, NONRENEWAL AND PREMIUM PAYMENT

On April 3, 2020 the Illinois Department of Insurance issued Bulletin No 2020-09 requesting P&C insurers consider implementing the following protective measures:
- Seek to postpone or withdraw any previous notice of cancellation or nonrenewal in which the cancellation or nonrenewal occurs on/after March 9, 2020 on any in-force policy.
- Consider postponing the issuance of any new cancellation or nonrenewal notices through April 30, 2020 or a later time if considered reasonable given an individual’s circumstances.
- Consider granting an extension of any policy provisions or other requirements that that impose a time limit for an insured or claimant to perform any act.

DEPARTMENT ISSUES BULLETIN CONCERNING PROPERTY DAMAGE DUE TO VANDALISM

On June 1, 2020, the Illinois Department of Insurance issued Company Bulletin 2020-15 to all property and casualty carriers in which it requested that insurers implement claims practices consistent with categorizing certain events that led to vandalism and looting as a catastrophic event for coverage purposes. Also, insurers were asked to implement a moratorium on the cancellation or nonrenewal of impacted policyholders for a period of 60 days from the date of the bulletin. The department also stated insurers should base payouts under a business interruption provision on the business activity levels that eliminate the impact of COVID-19.
